Terms of Service

These are the terms you agree to by using Phase+. They are short on purpose. The 3 that matter most: Phase+ is a coaching tool and not a doctor, you have to be 18, and if you pay and change your mind within 14 days you get your money back.

1. Who you are agreeing with

Phase+ is operated by Sara Ramirez Arevalo, NIF 60190525P, Carrer de Comerç 4, Piso 2, 08003 Barcelona, Spain, contactable at hello@trainphase.com. In these terms that is "Phase+" or "we", and you are "you".

By creating an account you accept these terms and the Privacy Policy. If you do not accept them, do not create an account.

2. What Phase+ is, and what it is not

Phase+ is a nutrition and training tool. You log what you eat, what you weigh, how you train and where you are in your cycle, and it sets you daily targets and writes you a Check-in every 2 weeks with one thing to change.

Read this paragraph even if you skip the rest. Phase+ is not a medical device, not a doctor, and not a dietitian. Nothing it produces is medical advice, a diagnosis, or a treatment plan, and it is not a substitute for professional care. Its targets and estimates are exactly that, estimates, produced from what you enter and from published formulas that hold on average and not for everybody. Photo calorie estimates in particular are a fast first draft, not a measurement.

You are responsible for what you do with it. Talk to a doctor before changing how you eat or train, and especially if you are pregnant or breastfeeding, have or have had an eating disorder, have diabetes, a thyroid, heart, kidney or liver condition, or take medication that interacts with what you eat. If any of that applies, use Phase+ alongside your clinician, not instead of one. If you are unwell, stop using it and get medical help.

3. Who can use it

You must be 18 or over. This is a stricter floor than Spanish law sets, chosen because a product that sets calorie targets and asks you to weigh yourself should not be handed to a minor. By creating an account you confirm you are 18 or over. Accounts found to belong to someone younger are deleted.

4. Your account

• One account per person. Do not share it, and do not let someone else use it.
• Sign-in is by Google or by a one-time link sent to your email, so keep control of that email address. Anyone with access to it can get into your account.
• Give accurate information. Targets built from a made-up height or weight are worthless, which is your loss rather than ours.
• Tell us if you think somebody else has got into your account.

5. How you may use it

Use it for yourself, for its purpose. Do not:

• Break into, overload, scrape or reverse-engineer the service, or try to reach data that is not yours.
• Resell it, or use it to provide a service to other people without an agreement to do so.
• Upload anything unlawful, anything that is not yours to upload, or a photo of another person who has not agreed to it.
• Use the feed to harass anybody, or to promote extreme restriction, purging, or anything else that would push another user toward disordered eating. This one is enforced without warning.
• Use automated means to create accounts, farm referral credits, or generate traffic.

6. What you post, and who owns it

Everything you log and every photo you take stays yours. Phase+ claims no ownership of it.

To run the product we need permission to use it in the obvious ways: to store it, to show it back to you, and, for anything you deliberately publish to the feed or share by link, to show it to the people you shared it with. That permission is limited to operating Phase+, is worldwide and royalty-free because the internet is, and ends when you delete the content or your account. Your content is never used in marketing without asking you first.

Posting to the feed is a publication. Treat it that way: another user can see it, and can screenshot it. Nothing you have not posted or shared is visible to anyone else.

7. Subscriptions and payment

Phase+ is free to use for logging, targets, and your first 2 Check-ins. After that, Check-ins need a subscription.

• Prices include VAT where it applies. There is no free trial on either plan, and no hidden add-on.
• Payment is taken by Stripe. Your card details go to Stripe, never to Phase+.
• It renews automatically until you cancel, which is how a subscription works and is said here so it is never a surprise. Cancel any time in Account, in one action, with nobody to talk to and no retention flow to escape. You keep access until the end of the period you already paid for.
• If a price changes, it will not change for you mid-period, and you will be told by email at least 30 days before it applies to a renewal. If you do not want the new price, cancel before then.
• If a payment fails, access to paid features pauses until it goes through.

8. Your 14-day right to change your mind

As a consumer in the EU you have 14 days from the day you subscribe to withdraw, for any reason or none, under Spanish Royal Legislative Decree 1/2007. Email hello@trainphase.com saying you withdraw, or use any clear wording you like, and you will be refunded in full within 14 days, to the same card you paid with.

One thing to know, because the law requires it be made explicit. Phase+ is digital content supplied immediately: the moment you subscribe, the paid Check-in is unlocked. When you subscribe you are asked to confirm that you want it to start straight away, and you acknowledge that once you have used a paid Check-in, the right to withdraw for that subscription period is lost. If you subscribe and do not use a paid Check-in, your full 14 days stand untouched. If you would rather keep the 14 days intact, subscribe and wait.

9. Refunds outside those 14 days

There is no obligation to refund after 14 days, but the practice is simple and generous: if the product did not work, was unavailable for a meaningful stretch, or you were charged for something you did not get, email and it will be put right. Your statutory rights as a consumer, including the right to a remedy where the service is not as described, are not affected by anything in this section.

10. Referral credits

Referring someone can earn you free Check-in credits. Credits have no cash value, cannot be transferred or sold, and can be withdrawn if they were farmed with fake accounts. The scheme can be changed or ended at any time, and credits you already hold will be honoured if it is.

11. Changes to the product

Phase+ is actively built, so features appear, change, and occasionally go away. If a paid feature is removed and not replaced, and that materially reduces what you are paying for, you can cancel and be refunded for the unused part of the period.

12. Availability

Phase+ is provided as it is, with no promise of uninterrupted service. It runs on third-party infrastructure and there is no uptime guarantee and no service credit scheme. There is also no guarantee of a particular result: Phase+ can tell you what your numbers say, and it cannot promise you a body.

13. Liability

Nothing here limits liability that cannot lawfully be limited, which includes death or personal injury caused by negligence, fraud, and your rights under Spanish consumer law. Those come first, whatever the rest of this section says.

Beyond that: Phase+ is not liable for indirect or consequential loss, or for lost profit or lost data, and total liability for any claim is capped at the greater of the amount you paid in the 12 months before it arose, or €50. Phase+ is not liable for a health outcome that follows from a decision you made using its estimates, which is the whole reason section 2 exists.

14. Ending this agreement

You can leave at any time by deleting your account in Account, which erases your data (see the Privacy Policy). Cancel any subscription first, or email and it will be handled.

Your account can be suspended or closed if you break section 5, if payment is fraudulent, or if required by law. Except where the breach is serious or unlawful, you will be told first and given a chance to fix it, and you can export your data before it goes.

15. Intellectual property

The Phase+ name, the site, the app, and the way it works are owned by Phase+. You get the right to use the product, not the right to copy it.

16. Law and disputes

These terms are governed by Spanish law. As a consumer you can bring a claim in the courts where you live, and nothing here takes that away.

Talk to us first, at hello@trainphase.com. Most things that look like a dispute are a bug or a misunderstanding, and both are cheaper to fix by email. If that fails, you may also use the European Commission's online dispute resolution platform.

17. Changes to these terms

These terms can change as the product changes. The date at the top moves when they do, and a material change is announced by email or in the app at least 30 days before it takes effect, so you can leave if you disagree. Continuing to use Phase+ after that is acceptance.
